Mushroom Culture Sale Agreement

1. Product Standard: At Cape Town Exotic Mushrooms, we are constantly cultivating and testing our cultures. We screen and maintain all our cultures to ensure they are vigorous and high yielding. For more information on our breeding process please see our Value System. Our laboratories meet the criteria for class 100 clean rooms. A class 100 cleanroom contains no more than 100 particles per cubic foot. By comparison, a typical office space contains between 500,000 and 1 million particles per cubic foot. In addition to working in these strict conditions, we perform all sterile work in front of commercial standard laminar flow hoods. This ensures the sterility of our high-quality mushroom cultures.

2. Use of Mushroom Cultures. Your mushroom cultures will arrive in test tubes, petri dishes and liquid culture syringes. Upon receipt of your culture(s) make backups, then store your backups appropriately. After making your backups, you must conduct mini trials from your culture(s) by growing out samples on suitable substrate. You are cautioned not to rely on the suitability or vigorousness of the strains until you have completed your mini trials. Upon successful completion of mini trials, you may grow out the cultures on suitable substrate. Please contact Cape Town Exotic Mushrooms for questions about storage, backups, substrate compatibility, mini trials or other practical aspects of working with this mycelial culture.

3. Terms of Sale. All mushroom cultures must be paid for in full prior to shipping. Customers are responsible for all shipping, handling, duty and tariff charges. There may be restrictions on importation of live mushroom cultures to certain destinations, so check with your local customs agents. Mushroom culture prices and shipping options are updated at www.capetownexoticmushrooms.com. Please check for current pricing and availability, which may vary from time to time.

It is the responsibility of the foreign customer to research and fulfil the requirements for importation of live mushroom mycelium into his or her country. Cape Town Exotic Mushrooms will take no responsibility for the loss or damage of live cultures seized or detained because of improper or missing documentation. International orders returned to Cape Town Exotic Mushrooms (due to any circumstances) will not be refunded except at the sole discretion of Cape Town Exotic Mushrooms.

To assist Cape Town Exotic Mushrooms in its continuing research and with customer warranty or other questions about mushroom cultures: customers agree to provide information about Cape Town Exotic Mushrooms cultures or when requested. The information you provide will allow us to improve our products and customer services.

4. Limited Warranty. Cape Town Exotic Mushrooms stands behind the quality of our mushroom cultures, guaranteeing their vitality and purity to our customers. Should any culture stored and used according to this Mushroom Culture Sale Agreement fail to demonstrate vitality and purity, we will promptly replace it. Simply provide a written explanation of the issue you’re experiencing, forward the culture to us (along with shipping costs). We will replace the culture at no extra charge, subject to availability. In the event that the desired culture is unavailable, we’ll discuss alternative options with you.

Before using your culture, please remember to make backups and store them appropriately. Cape Town Exotic Mushrooms shall not be responsible for consequential damages or other damages except as specified, this is the sole and exclusive limited warranty provided by Cape Town Exotic Mushrooms and customers agrees that the limit of Cape Town Exotic Mushrooms liability to customers shall be the purchase price.

5. Limitation of Use: Your purchase of Cape Town Exotic Mushrooms culture(s) is subject to your agreement to comply with the following limitations of culture(s) use:

  • You may not sell Cape Town Exotic Mushrooms spawn or cultures, or any spawn or cultures subsequently derived from them, without our written consent. However, you are permitted to use the cultures to grow and sell mushroom fruit bodies. You can fruit the culture, harvest spores, and isolate your own genetics for them, which you can then sell as your own cultures. However, it is prohibited to replicate and sell cultures or spawn derived directly from the original genetics. While we appreciate healthy competition, we have dedicated significant time and effort to finding and developing our genetics. Essentially, if you wish to create products that compete with ours, you’ll need to do your own legwork and find your own mushroom strains to work with.
